A hit-and-run can lead to deportation after trial.

“The moment you leave the scene, both investigation and deportation review can begin simultaneously.”   It is not uncommon for a foreign national who panicked and left the scene of an accident to realize only days later—after being contacted by the police—that they have become the subject of a criminal investigation. The real problem often arises afterward: during questioning, many are unable to clearly explain what happened, or the victim cannot be reached, leading to a situation where the foreigner’s position becomes increasingly disadvantageous.   This situation becomes even more burdensome when visa renewal or immigration review takes place at the same time as the criminal investigation.   For foreigners who are not fluent in Korean, it is extremely difficult to avoid disadvantages in both the criminal investigation and administrative review processes. Therefore, before the situation grows more complex, the most practical approach is to seek guidance from a legal professional who can help establish the right strategy for response.

1. How Are Foreigners Penalized in Traffic Accident Cases?

A traffic accident involving a foreign national is not treated as a simple traffic violation in Korea. In particular, if there is evidence that the driver left the scene, it can be classified as a “hit-and-run by a foreign national,” which carries far heavier penalties than an ordinary traffic accident.   Key legal standards include:
  1. For major traffic violations such as running a red light or crossing the center line (the “12 major negligent offenses”), the penalty can be up to 5 years in prison or a fine of up to 20 million KRW. If there were injuries, the chances of an actual prison sentence increase significantly.
  2. If the driver left the scene after the accident and the victim was injured, the court may impose imprisonment of at least 1 year or a fine between 5 million and 30 million KRW.
  3. If the victim died, there is no fine option — the punishment can be life imprisonment or a prison term of 5 years or more, and in such cases, a real prison sentence is highly likely.
It’s important to note that the actual level of punishment is not determined solely by the outcome of the accident. The court also considers what actions were taken immediately after the incident, whether a settlement was reached with the victim, and the evidence submitted during the investigation.   For foreign nationals, even after the criminal case concludes, immigration authorities may conduct a separate review, which can result in restrictions on visa renewal or forced deportation. Therefore, it is far more practical to establish a comprehensive response strategy that covers both the criminal investigation and the immigration review process from the very beginning.

2. Even After the Criminal Trial Ends, Immigration Review Continues.

Even if a foreign national involved in a traffic accident receives a fine or prison sentence, the matter is not over once the criminal trial concludes. In many cases, a separate immigration review begins afterward — and the result of that review can determine whether the person is allowed to remain in Korea.   For example, if a criminal court imposes a fine of 3 million KRW or more, it is quite common for the Immigration Office to issue a departure order or initiate a forced deportation review.   If the traffic accident involved injury or death resulting from a hit-and-run, this can also lead to entry bans or visa rejections for a certain period of time.   Furthermore, there are many cases where the current visa status is canceled or renewal is denied, so one should not assume that the issue is resolved simply because the trial has ended. Even if some charges were dismissed or cleared in criminal court, the Immigration Office may reach an entirely different conclusion based on its own assessment.   In particular, in cases involving foreign hit-and-run incidents, where evidence of flight or evasion remains, the immigration authorities apply far stricter standards. This is why it’s crucial to have a coordinated legal strategy that addresses both the criminal trial and the immigration review from the very beginning.

3. Why Is Legal Representation So Important?

A traffic accident involving a foreign national is not merely a matter of fines or sentencing. Depending on the nature of the incident, it can also trigger immigration review, affect residence status, and even lead to deportation, making the overall response process far more complex.   However, it is very difficult for a foreigner to fully understand and manage all of these overlapping legal and administrative procedures alone.   Even native Koreans often struggle to grasp the detailed standards and procedures of criminal law and immigration regulations. For foreigners, the language barrier and lack of familiarity with the legal system make it even harder to determine the proper course of action.   In many cases, individuals only realize the seriousness of the situation after receiving a fine notice or a court summons, and they seek legal help too late. In more severe cases, some do not contact a lawyer until after the criminal trial has concluded and they receive a notice from the Immigration Office regarding an upcoming review or deportation procedure.   As a result, many miss the opportunity to resolve their situation favorably at an early stage, ending up in reactive, last-minute responses instead of proactive defense.   In serious cases such as foreign hit-and-run incidents or major traffic accidents involving foreigners, it is crucial to consult a legal representative early on and establish a comprehensive strategy that addresses both criminal investigation and residence status management from the very beginning.

4. In Conclusion: From the initial response to the immigration review, a step-by-step, customized legal strategy is essential.

A traffic accident involving a foreign national does not end once the court trial is over.   Even after the criminal judgment, additional procedures such as residence extension reviews, visa renewal screenings, and deportation evaluations often follow. Therefore, a practical and effective response is only possible when the entire process is considered from the very beginning of the case.   In particular, for cases involving foreign hit-and-run incidents, the timing of settlement with the victim and the accuracy of your statement can directly determine whether you are allowed to continue your stay in Korea.   At our firm, criminal defense for foreign nationals is handled by attorneys experienced in foreign-related criminal cases, while immigration reviews are managed by specialists in immigration law, ensuring that each stage receives the tailored legal response it requires.   We don’t focus solely on reducing the level of punishment — we design comprehensive strategies that also consider residence stability.   By analyzing both the characteristics of the hit-and-run case and the client’s visa or residence status, we coordinate the criminal defense and immigration procedures together — the most realistic and effective approach under Korea’s legal system.   If you are involved in a traffic accident that could be classified as a foreign hit-and-run, seeking professional legal assistance immediately after the incident, rather than waiting for the trial to begin, is the most practical way to protect your right to continue living in Korea.     Multilingual consultation available in English and Chinese.   Professional interpreters assist from the first consultation to the conclusion of the case.   Offices in Seoul, Daejeon, Busan, Daegu, and Gwangju   Don’t face the legal system alone.
