1.What is the level of criminal punishment for traffic accidents caused by foreigners?

Not all traffic accidents end lightly. Especially when a foreign national is involved, the case can extend beyond criminal punishment to issues related to maintaining residency.   The key point is that how you respond after the incident can directly influence the severity of the punishment.   Below are examples of major types of incidents and their corresponding penalties.
12 Major Negligence Traffic Accidents ▶ Imprisonment of up to 5 years or a fine of up to 20 million KRW   If a person is injured after fleeing the scene ▶ Imprisonment of at least 1 year or a fine between 5 million and 30 million KRW   If a person dies after fleeing the scene ▶ Life imprisonment or imprisonment of at least 5 years (No option for a fine)

2.What immigration sanctions could be made after the punishment of traffic accidents involving foreigners?

Just because a criminal trial has ended doesn’t mean residency issues are resolved.   When a person receives criminal punishment from such an incident, the consequences go beyond the court’s ruling.   Criminal records also affect administrative procedures and can serve as grounds for additional review during immigration processes.   Immigration measures are carried out independently by administrative authorities, separate from the court’s criminal judgment.   As a result, the following actions may follow.   ① If a fine of 3 million KRW or more is imposed, the individual may be requested to leave the country or face deportation procedures.   ② In cases classified as serious crimes, such as those involving injury or loss of life, long-term entry restrictions or visa issuance denial may apply.   ③ Depending on the current visa status, the individual's stay may be revoked or extension may be denied.

3.Why do we need a legal representative for traffic accidents involving foreigners?

A single decision in the early stages can change both the outcome of the case and your ability to remain in the country.   If you're involved in such an incident, it's not simply a matter of paying a fine and moving on.   Because the case can extend beyond criminal proceedings into residency issues, having a trusted advisor to guide you through the process becomes essential.   ① Due to differences in language, culture, and legal systems, communication with investigative authorities can easily become confused, and there is a high risk of misunderstandings or procedural errors during the initial response.   ② Each stage—settlement with the victim, criminal proceedings, and immigration control—requires separate preparation. Missing any of these steps can jeopardize the individual's visa status.   ③ A legal representative experienced in handling criminal cases involving foreigners can identify potential legal issues at each stage in advance and establish a foundation for influencing the actual outcome through strategic responses and written opinions.

4.Case studies: Traffic accidents involving foreigners

① Client Background
A Russian national working in Korea obtained a driver’s license in 2021 and had been driving without any violations for about three years while maintaining a diligent work record.   One day, while commuting home, he entered an 8-lane intersection without noticing a signal change. Due to the road’s structure, which posed a risk of rear-end collisions when stopping mid-intersection, he continued driving and accidentally struck a pedestrian who was jaywalking. The pedestrian suffered a fractured arm after the incident.   As a result, the foreign worker faced criminal charges and became subject to review under immigration law. If fined more than 3 million KRW, he risked losing his residency status and facing a serious disruption to his livelihood.
② Response Strategy & Key Issues
We reviewed the client’s residency status, the circumstances of the incident, and the potential immigration consequences to develop a step-by-step response strategy.   - Demonstrated Responsible Driving History and Lifestyle The client had driven without incident for three years and consistently maintained a responsible work ethic. We emphasized that the accident was not intentional but a momentary lapse in judgment. A letter of support from his employer was submitted to reinforce this point.   - Proved Settlement and Victim’s Non-Punishment Intent After the incident, the client actively supported the victim’s recovery, leading to a mutual settlement. The victim expressed a desire not to pursue punishment, which was officially documented.   - Highlighted the Real-World Impact of Deportation We explained that a fine exceeding 3 million KRW could trigger deportation review, potentially resulting in loss of residency and income. We urged the court to consider not only the legal framework but also the practical consequences of such a decision.
③ Outcome
The court took into account the client’s remorse, the amicable settlement with the victim, and supporting social documentation. As a result, the fine was reduced to 2.5 million KRW, allowing the client to avoid deportation and continue living in Korea.

5.Final words

Why Is It Difficult to Handle Unlicensed Driving and Traffic Accidents Alone as a Foreigner?   Depending on how the case is handled, it may end with just a fine—or escalate to deportation.   Traffic accidents involving unlicensed foreign drivers are not just simple legal matters. They often involve both criminal proceedings and immigration reviews.   Since these processes are handled independently, responding only to the police investigation may not be enough to resolve the entire case. In many cases, deportation orders are issued sooner than expected, or visa extensions are denied.   In situations where criminal trials and administrative actions overlap, expert interpretation and experience can significantly influence the outcome.   Because your initial response can determine whether you’ll be allowed to stay in Korea, the safest approach is to seek help from a legal representative who specializes in such cases—rather than trying to handle it alone.   Legal issues may drag on, but the direction is set from the beginning.   Foreign Specialized Support at Majung Foreigner Center Multilingual consultation available in English and Chinese.
