Foreign Spouse Divorce: Can Public Service Be Used?

  When the other party has left the country and all contact has been lost, it’s common for the divorce process to be blocked from the very beginning.   To legally end a marriage with a foreign national spouse, the first step is to deliver the necessary legal documents. However, if the other party is no longer in Korea, the method of delivery itself must be reconsidered.   In particular, if a foreign wife has left the home and her current address is unknown or difficult to verify, the case often cannot even be initiated.   There are exceptional procedures that can be used in such cases, but for the court to accept them, concrete evidence is required. A simple statement alone is often not enough to proceed.   Divorce involving a foreign spouse is not just a matter of the court’s final ruling — structural requirements must be met just to begin the process.   In situations where the case stalls at the service (delivery) stage, the role of a legal representative becomes crucial in getting the case back on track.

1. If You’re Facing Divorce from a Foreign Spouse, What Are Your Realistic Options?

  Whether you can reach the other party, what country they are currently in, and their nationality — all of these factors determine the available legal paths for divorce.   Depending on the situation, there are three main approaches:   ① Mutual Agreement – “Presence” is More Important Than Just “Agreement” If both parties are willing to end the marriage and the foreign spouse is currently in Korea, the divorce can be finalized smoothly through mutual agreement. However, both spouses must appear in person at the family court to express their intent clearly. If the spouse is overseas or unwilling to appear, proceeding with this method becomes practically difficult.   ② Mediation – A Flexible Middle Ground Between Litigation and Agreement When direct communication is difficult, court-led mediation may be the most appropriate route. It involves less time and cost than a full trial, and if an agreement is reached, the process can conclude quickly. Even if the other party is abroad, they can participate through a legal representative in Korea, making this a practical and viable option.   ③ Litigation – The Final Option When the Spouse is Unreachable or Location Unknown Litigation is not permitted based solely on conflict or emotional disputes. For the court to grant a divorce, there must be legally recognized grounds as specified in the Civil Code, supported by factual evidence. If the foreign spouse has gone missing or cannot be located due to abandonment or other reasons, the process can begin through public notification (service by publication). If all legal requirements are met, the case can proceed even without the other party’s response. Ultimately, the key is to ensure that the grounds for divorce are valid and clearly substantiated under the law.    

2. How Can Legal Documents Be Delivered to a Spouse Who Is Out of Contact?

  If a foreign wife has left the home and the spouse’s address or contact information is unclear, it is not possible to initiate divorce proceedings through standard service methods.   In cases where all practical means of contact have been severed, divorce by public notification (service by publication) can be used as an exception.   This system allows legal documents to be “delivered” by posting them on a court bulletin board for a designated period, but only if the court determines that certain legal conditions have been met.   Efforts to locate the other party — such as checking immigration records, verifying deregistration from the resident registry, and searching for actual addresses — must be objectively proven.   Even if direct service is not possible, the court may still allow the proceedings to move forward if it acknowledges that the requirements have been met.   Divorce by public notification is a special legal mechanism permitted only when standard methods of document delivery are not feasible.    

3. Why Is Legal Representation Necessary?

  Divorcing a foreign spouse is not just a matter of paperwork — it is a complex legal issue involving multiple areas such as international law, immigration law, family law, and real-life situations like a foreign wife’s disappearance.   ① Nationality Alone Is Not Enough   Under private international law, determining which country’s law applies and which court has jurisdiction is a key issue. If these matters are not clearly established, it becomes difficult to proceed with the case properly from the outset.   ② The Foreign Spouse’s Visa Status Is Not Automatically Handled   Depending on the court’s ruling, visa matters such as continuation of an F-6 spousal visa, change of status, or even deportation notice may follow. These administrative and legal outcomes are closely connected and must be addressed within an integrated legal strategy.   ③ Divorce by Public Notification Requires Strategic Planning Simply claiming “I cannot contact my foreign wife because she left” is not sufficient. The core requirement is being able to document the efforts made to locate the spouse. Without objectively organized proof — such as checking immigration records, searching former addresses, and gathering witness statements — the court may refuse the request for service by publication, and the case could be halted entirely. Many cases are dismissed at the very beginning due to a lack of experience or preparation. Public notice divorce is not a routine process — it is a procedural step that demands careful strategy and precise timing.    

4. Divorce by Public Notice Against an Untraceable Foreign Spouse — Case Where Alimony Was Also Granted

  A Korean national client registered marriage with their Filipino spouse, Mr. W, in 2015. However, just two months later, the spouse returned to the Philippines and completely cut off all contact.   For several years, the spouse’s whereabouts remained unknown, making it impossible to maintain a real marital relationship. The client ultimately decided to pursue legal action.   The legal representative argued that the spouse’s unilateral departure and prolonged disappearance constituted abandonment. After taking all possible steps—such as checking immigration records, conducting inquiries, and attempting to locate the address—the case was initiated through divorce by public notification, having met the necessary legal requirements.   As a result, the court granted the divorce and also ordered the spouse to pay 20 million KRW (approximately $15,000 USD) in damages for emotional distress. This allowed the client not only to obtain legal closure but also to achieve meaningful emotional and financial recovery.  

5. Final words
