International Marriage Fraud Is Not Just a Simple Divorce Matter

  Even when a marriage appears to be based on love, many cases involve one party seeking financial gain.   In cases of fake foreign marriages or fraudulent international marriages, it is common for the couple to have only registered the marriage without any intention of living together. Sometimes, one party hides a past criminal record or marries under a false identity. It’s also not uncommon for the spouse to demand money shortly after marriage, citing investments or debts owed to their parents, and then cut off contact.   These situations often do not become apparent at the beginning, and victims usually discover the full extent of the fraud much later.   The bigger issue is that these cases are rarely resolved through simple divorce proceedings.   In cases of foreign marriage fraud, legal actions often involve annulment or cancellation of the marriage, along with claims for damages due to the other party’s deceptive acts.   Therefore, the most practical way to minimize unnecessary damage and save time is to develop a response strategy early on with a legal representative experienced in handling foreign marriage fraud cases.

1. In What Situations Can You File a Lawsuit for Marriage Annulment?

  One of the first legal procedures to consider in international marriage fraud cases is a marriage annulment lawsuit.   In the case of a sham foreign marriage, even if the marriage has been officially registered on paper, it may not be legally recognized as a valid marriage if there was no real intention to live together or no firm commitment to a shared life.   Situations in which a marriage annulment lawsuit is commonly pursued include:
  • When there was no genuine intent to marry from the beginning
  • Bigamous marriages (where one party is already married) or marriages between relatives prohibited by law
  • Marriages based on concealed or falsified identities
  The key issue is whether the marital relationship is legally valid.   The court examines whether there was actual intent to cohabit, cooperate, and live together as a married couple. Even if one party intended to build a family, the marriage may be annulled if the other party approached the relationship solely for financial gain or other ulterior motives from the outset. In such cases, the court may rule that no real marriage existed and declare it invalid.    

2. In What Cases Is International Marriage Cancellation Recognized?

  In international marriage fraud cases, marriage annulment is often considered alongside marriage cancellation.   Marriage cancellation acknowledges that the marriage was legally established, but if serious flaws are found in the process, the court may declare the marriage invalid through legal proceedings.   These cases generally fall into three main categories: 01: When one party intentionally hides important facts—such as health conditions, criminal records, or excessive debt—as is common in fraudulent foreign marriages. 02: When one party was forced into marriage due to coercion or sustained pressure. 03: When, at the time of marriage, one party lacked the mental capacity to understand or make an informed decision about the marriage.   If you're filing for marriage cancellation due to fraud or coercion, be aware that the filing period is shorter than expected.   You must file within three months from the date you became aware of the fraud or were freed from coercion. If this time limit passes, the case is likely to proceed as a regular divorce instead of a cancellation.   If the court grants marriage cancellation, the marriage is recognized as having occurred, but its legal effect is considered void from the beginning.   In addition, the petitioner can still seek alimony or property division, and in some cases, file a separate claim for damages.    

3. Real Case: Annulment of a Fraudulent Foreign Marriage for Visa Purposes

  In 2015, the client registered a marriage with a Vietnamese national through an international marriage agency. However, based on later findings, it appeared that the spouse had no intention of building a family from the start and had used the marriage solely as a means to obtain residency in Korea. Despite the official registration, the couple never lived together, and just two months after the marriage, the spouse left for her home country without any notice and completely cut off contact.   After carefully reviewing the situation, the client concluded that the case likely involved marriage fraud, and proceeded to file a marriage annulment lawsuit, arguing that the marriage lacked legal substance.   With the support of legal counsel, the client provided evidence showing that the spouse had concealed her true intentions, only went through the paperwork for registration, and never intended to maintain a marital relationship. This included proof of her sudden departure, lack of communication before and after the marriage, and the absence of any shared life.   Since the spouse’s whereabouts were unknown, the lawsuit proceeded through service by publication. The court ruled that there was no genuine marital relationship from the beginning and granted the annulment.   As a result, the client was completely freed from the legal bond of this fraudulent foreign marriage and was also awarded compensation for emotional damages caused by the spouse’s deceit.
