Is Visa Extension Automatic After Divorce When Raising a Child in Korea?

A foreign spouse who remains in Korea after a divorce for the purpose of raising a child continues to apply for visa extensions.   In this situation, I would like to know whether the extension of stay is granted automatically without a separate application, or whether an application procedure and fee are required each time.   In addition, when staying in Korea for child custody and parenting purposes, I would also like to know what factors are considered important during the visa extension review process.
  A. Answer

If you wish to continue staying in Korea after divorcing your foreign spouse for the purpose of raising your child,

it is understandable that you may have many questions regarding visa status maintenance and extension procedures.

To summarize your situation,

① You are divorced from your foreign spouse

② You wish to continue staying in Korea for the purpose of raising your child

③ You are wondering whether future visa extensions are automatic and whether fees and procedures are required

Based on this situation,

I will explain the visa status and extension procedures step by step.

First, Cases Where Visa Status May Be Maintained After Divorce

Even if a foreign spouse originally held a visa status through marriage to a Korean national (such as an F-6 visa) and later divorced,

it may still be possible to maintain or change visa status

if the person is actually raising the child.

Generally, this may be recognized through

▪️ a visa status for child custody and parenting purposes (maintenance or change of F-6 status)

▪️ permission to stay based on humanitarian reasons.

However, visa status is not maintained automatically simply because a divorce occurred. The key issue is "whether the person is actually and substantially raising the child".

Second, Extension of Stay Is NOT Automatic

This is the main point of your question.

Visa extensions are not granted automatically.

You must

✔ personally submit an extension application to the immigration office

✔ approval will be determined through a review process

Therefore, if the authorized stay period expires without a separate application, the individual may become an overstayer, so caution is necessary.

Third, Fees for Extension Applications

A certain application fee is charged when applying for an extension of stay.

In other words

✔ the system is not designed for free automatic extensions

✔ a fee is charged each time an application is submitted.

The exact amount may vary depending on the visa type and extension period.

Fourth, Main Factors Considered During Extension Review

When determining whether to approve an extension of stay, immigration authorities generally consider

▪️ the child’s nationality and age

▪️ actual parenting and custody circumstances (living together, child support responsibilities, etc.)

▪️ the applicant’s basis for living in Korea (employment, income, etc.)

을 종합적으로 고려합니다.

Therefore, simply having a child does not automatically guarantee extension approval. The most important standard is “actual and substantial parenting.”

Fifth, Important Points to Keep in Mind

After divorce, immigration review for visa extensions may become stricter compared to situations where the marriage relationship is still maintained.

In particular

✔ if there is insufficient proof of actual child custody and parenting

✔ if the applicant’s basis for staying in Korea is unclear

the extension application may be denied

For this reason, preparing sufficient supporting documents in advance is very important.

As in your situation, where a foreign spouse remains in Korea after divorce for the purpose of raising a child, it may still be possible to maintain or change visa status.

However

extensions of stay are not automatic,

applications and immigration review are always required,

and application fees also apply.

Therefore, it is important to prepare the necessary documents and apply for an extension before the current stay period expires.

If necessary, I would recommend obtaining a more detailed legal review based on your individual circumstances.

Thank you.
