If a foreigner is being investigated as a theft suspect, what should they prepare first? (+Real Case)

  Today, I’d like to review the response process through a real case in which a client was investigated on suspicion of theft as a foreign national.   A Swedish client became subject to a police investigation after leaving a large shopping mall in Korea without paying for a coat he had tried on. At first, he thought it was a simple mistake, but as the investigation progressed, he was shocked to learn that the theft allegation had been formally registered as a case and that his immigration status could also be at risk.   As this case shows, even seemingly minor theft incidents involving foreigners can result in permanent investigation records. Once that happens, it may lead to disadvantages during visa renewals or residency extension reviews. Furthermore, if the individual is not fluent in Korean or is unfamiliar with the procedures, their remorse and intent to apologize may not be properly conveyed during the police investigation, leading to even greater misunderstandings.   In this case, the decisive factor in obtaining leniency was that a legal representative participated in the investigation from the outset, quickly handling matters such as reaching a settlement with the store and submitting a written statement.   Foreign-related crimes do not simply end with a fine; they can directly affect whether one is able to continue residing in Korea, making early legal intervention all the more important.

1. Foreigner theft cases – what happens after criminal punishment matters even more.

  When a foreigner in Korea becomes involved in a criminal case such as theft or assault, the situation often does not end simply with a fine or a favorable ruling.   This is because, after a criminal disposition is made, a separate review of residency status takes place. Therefore, one cannot feel reassured just because the investigation is over. Crimes like theft, which undermine social trust, can result in visa extension refusals or even deportation orders, even for first-time offenders, and thus require greater caution.   In practice, it is often not the scale of the offense but rather the mere fact that “a foreigner committed a crime in Korea” that heavily influences immigration authorities’ decisions. If the response is delayed, one’s entire basis for staying in the country may be cut off.   For this reason, even if the criminal punishment itself is light, it is essential to respond with consideration for what records will remain in immigration review.    

2. Why is the help of a legal representative necessary?

  Even in relatively minor cases such as theft involving foreigners, simply admitting fault and offering an apology is often not enough to resolve the matter.   If statements are unclear or if written reflections or apology letters are not submitted to the investigative authorities, favorable circumstances may not be reflected in the official record, which can affect the outcome of the case. This, in turn, can directly influence future residency extension reviews. Furthermore, even if a settlement with the victim is reached, if it is not legally formalized, it may later become a source of renewed problems.   In particular, in foreigner-related criminal cases, every step of the process—from drafting settlement documents, preparing clear statements, responding to investigations, and submitting written opinions—can directly impact the review of residency status. Therefore, simply completing the investigation does not guarantee peace of mind.   With the assistance of a legal representative, the client’s position can be clearly conveyed, the legal validity of settlements can be secured, and the entire strategy can be aligned with the goal of maintaining residency.   As such, foreigner-involved cases do not conclude solely with the criminal process. Because immigration procedures are connected from the very beginning of the investigation stage, seeking professional assistance right away is a much safer course of action.    

3. Foreigner theft case – a real example of legal response.

  01: A Foreign Crime Arising from a Momentary Mistake A Swedish client residing in Korea visited a clothing store inside a large shopping mall. After trying on clothes, he left the store without paying for a coat. The store regarded this as theft and reported the incident, leading to a scheduled police investigation for a foreigner-related criminal case. From the beginning, the client admitted his mistake and expressed deep remorse, explaining that he had been going through a very difficult personal situation at the time which clouded his judgment. Since he was not fluent in Korean and felt overwhelmed by the investigation process, he sought the assistance of a legal representative to prepare for police questioning and settlement procedures.   02: From Apology at the Store to Statement Preparation – Responding to the Investigation The client appeared at the police investigation together with his attorney, having prepared and submitted a handwritten letter of reflection and an apology in advance. During the investigation, he fully admitted to the charges and sincerely apologized to the store, respectfully asking for forgiveness. Following the investigation, the store requested payment for the coat. The client personally visited the store, settled the payment, and once again offered a sincere apology. The store then indicated its willingness to reach a settlement, though it explained that confirmation from the head office would be necessary. After a period of review, a formal and amicable settlement was ultimately concluded.   03: Submission of Settlement and Opinion Letter – Leniency Without a Fine Once the settlement was officially finalized, the police decided to refer the case to a summary trial procedure. As a result, the case was concluded with a suspended fine of 100,000 KRW, without any separate settlement payment. Importantly, the disposition did not create a criminal record, meaning no conviction remained on the client’s record. This case shows that even in foreigner theft incidents, if the investigation response and settlement process are diligently prepared from the start, it is fully possible to resolve the matter without leaving disadvantages that affect residency.    

4. Foreigner crimes – how to protect both leniency and residency.

  In foreigner-related criminal cases, the issue is not only about what crime was committed. Even in theft cases involving foreigners, the outcome can differ greatly depending on how statements are organized, how a settlement with the victim is arranged, and what kind of response is taken from the very beginning of the investigation.   In particular, after the criminal disposition, a separate review of residency status takes place.
